PRIVACY POLICY

This Privacy Policy (“Policy”) describes how Fishbowl Challenge and its affiliates (“Fishbowl Challenge” or “we” or “our”) treat information collected or provided in connection with an end user’s (“you” or “your” or “user”) use of the Fishbowl Challenge website (the “Site”) and all services provided by Fishbowl Challenge in connection therewith (such Site and services, collectively, the “Services”).  Please note that your use of the Services constitutes your acceptance of this Policy as set forth below:

Effective Date; Changes. 

This Policy applies to all information collected by or provided to us in connection with the Services.  When we make any material changes to this Policy, we will change the Effective Date above and will inform you through the Services the next time you login.  We will treat your continued use of the Services following such notice as your acceptance of the changes. 

  

Third Parties. 

The Services may contain, and we may send to users, offers from third parties or links to third-party websites.  This Policy does not apply to information that you may provide to or that may be collected by third parties.  We encourage you to request that such third parties provide you with their applicable privacy policies and other terms and conditions before engaging with or making a purchase from such third parties.

Collected Information

Information You Submit.  When you submit an application, make a donation, or use certain features of the Services, such as the “Contact Us” feature, we collect the information you provide in the applicable form.  This information includes personally identifiable information such as your mailing address, e-mail address, password and mobile phone number.  When we refer to “personally identifiable information” in this Policy, we mean information that we can directly associate with a specific person or entity without additional information.  To the extent you decline to share certain personally identifiable information with us, we may not be able to provide some or all of the features and functionalities found on the Services. 

 

Information Collected Automatically.  When you use the Services, we automatically gather certain non-personally identifiable information from you.  This includes: (a) usage information, such as information on when, how often and for how long you use the Services and the content you submit, download, and view; and (b) server log data such as the IP address, domain name, operating system, or the URLs from the websites you were visiting before you came to the Site; and (c) your software and hardware attributes (including device IDs), your general geographic location (e.g., your city, state, or metropolitan region), and certain cookie information. As described below, we collect this information through a number of means, including database analytic tools, server logs, cookies and other online tracking mechanisms.

Cookies. Cookies are small files that are stored on your computer by your web browser. A cookie allows the Site to recognize whether you have visited before and may store user preferences and other information. For example, cookies can be used to collect or store information about your use of the Site during your current session and over time (including the pages you view and the files you download), your computer’s operating system and browser type, your Internet service provider, your domain name and IP address, your general geographic location, the website that you visited before the Site, and the link you used to leave the Site.  If you are concerned about having cookies on your computer, you can set your browser to refuse all cookies or to indicate when a cookie is being set, allowing you to decide whether to accept it.  You can also delete cookies from your computer.  However, if you choose to block or delete cookies, certain features of the Site may not operate correctly. We may associate such non-personally identifiable information with the personally identifiable information that you provide in connection with the Services. 

 

Web beacons.  The Site or the emails that you receive from Fishbowl Challenge may use an application known as a “web beacon” (also known as a “clear gif” or “web bug”).  A web beacon is an electronic file that usually consists of a single-pixel image.  It can be embedded in a web page or in an email to transmit information, which could include personal information.  For example, it can allow an email sender to determine whether a user has opened a particular email.  

 

Third-party online tracking and behavioral advertising.  We also may partner with certain third parties to collect, analyze, and use some of the personal and other information described in this section.  For example, we may allow third parties to set cookies or use web beacons on the Site or in email communications from us. This information may be used for a variety of purposes, including online interest-based advertising, as discussed below (see the section entitled “With whom we share your information”). 

Transaction Information.   If you make a transaction through the Service, the third-party payment processor that Company may utilize from time to time will receive your payment information for purposes of processing such transactions.  Note that the Company does not receive your credit card information.

Use of Information.

We use the personally identifiable and non-personally identifiable information for a variety of purposes. These purposes include, for example: 

  • To submit information for the purposes for which you provided the information (such as processing an application into the Fishbowl Challenge competition).  We also use submitted information and collected information as necessary to provide the features and functionality of the Services to you;

  • To respond to your questions or requests concerning the Site or other services offered by us; 

  • To fulfill your requests for our Services or otherwise complete a transaction that you initiate;

  • To process donations made through the use of our Services; 

  • To send you information about our Services, such as e-mail notifications regarding updates or modifications to the Services or topics that are likely to be of interest to you, including newsletters, or other communications, including promotional emails and advertising;

  • To deliver confirmations, account information, notifications, and similar operational communications;

  • To analyze collected information relating to your use of the Services in order to help us improve the Services and develop and improve other products and services; 

  • To use submitted information and collected information to help troubleshoot problems, provide you with required notices, enforce our Terms of Service or to alert you to changes in our policies or agreements that may affect your use of the Service; 

  • To comply with legal and/or regulatory requirements; and

  • To manage our business, including the use of the Services for general marketing purposes. 

 

In addition to the purposes above, we use the information that we collect automatically through the Site for such purposes as:  

 

  • Counting and recognizing visitors to the Site; 

  • Analyzing how visitors use the Site and various Site features; 

  • Improving the Site and enhancing users’ experiences with the Site; 

  • Creating new products and services or improving our existing products and services; 

  • Enabling additional website analytics and research concerning the Site; 

  • Engaging in interest-based advertising (as described below); and 

  • Managing our business.  

 

Fishbowl Challenge may link information gathered through the Site with information that we collect in other contexts.  But in that event, we will handle the combined information in a manner consistent with this Policy.

 

Disclosure of Information. 

We do not sell or distribute your information to third parties for their own purposes, in any form except as provided in this Section.  We share your information with other parties for a variety of purposes, as described below:  

 

Analytics Sites.  We may use certain third-party services to assist us in analysis, auditing, research, and reporting regarding the Services.  These third parties may use web logs or web beacons, and they may set and access cookies on your computer or other device.  In particular, we use Google Analytics and Visitor Analytics to help collect and analyze certain information for the purposes discussed in this Policy.  For information about the privacy practices of Google Analytics, you can visit http://www.google.com/policies/privacy/partners/. Interest-based Advertising.  The Site also enables third-party tracking mechanisms to collect information about you and your computing devices for use in online interest-based advertising. For example, third parties may use the fact that you visited our Site to target online ads to you.  In addition, our third-party advertising networks might use information about your use of our Site to help target advertisements based on your online activity in general.  For information about interest-based advertising practices, including privacy and confidentiality, visit the Network Advertising Initiative website or the Digital Advertising Alliance website.

 

The use of online tracking mechanisms by third parties is subject to those third parties’ own privacy policies, and not this Policy.  If you prefer to prevent third parties from setting and accessing cookies on your computer or other device, you may set your browser to block cookies.  Additionally, you may remove yourself from the targeted advertising of companies within the Network Advertising Initiative by opting out here, or of companies participating in the Digital Advertising Alliance by opting out here.  Although our Site currently does not respond to “do not track” browser headers, you can limit tracking through these third-party programs and by taking the other steps discussed above.

 

Third-party service providers.  Fishbowl Challenge uses third-party service providers that perform services on our behalf, including web-hosting companies, payment processors, mailing vendors, and analytics providers.  These service providers may collect and/or use your information, including information that identifies you personally, to assist us in achieving the purposes discussed above.

 

We may share your information with other third parties when necessary to fulfill your requests for services; to complete a transaction that you initiate; to meet the terms of any agreement that you have with us or our partners; or to manage our business.


 

Legal purposes.  We also may use or share your information with third parties when we believe, in our sole discretion, that doing so is necessary:

 

  • to comply with applicable law or a court order, subpoena, or other legal process; 

  • to investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of our terms and conditions, or situations involving threats to our property or the property or physical safety of any person or third party; 

  • to establish, protect, or exercise our legal rights or defend against legal claims; or  

  • to facilitate the financing, securitization, insuring, sale, assignment, bankruptcy, or other disposal of all or part of our business or assets.

Aggregated information.  From time to time, Fishbowl Challenge may also share aggregated information about Site users, such as by publishing a report on trends in the usage of the Site.  Such aggregated information will not identify you personally.

 

  1. Choice. To the extent we send you commercial e-mails and notifications regarding third-party marketing or promotional materials, we will give you the ability to opt-out of receiving such e-mails in accordance with applicable law.  We will not provide your personally identifiable information to third parties for their own marketing purposes without your consent. You may opt-out of receiving marketing emails from us by following the instructions in those emails or by emailing us at [info@fishbowlchallenge.com].

  2. Viewing and Amending Information.  If you want to learn more about the personal information that Fishbowl Challenge has about you, or you would like to update that information, please contact us by email at [info@fishbowlchallenge.com].  Please note that while changes to your account information are reflected promptly in active user databases, our servers may retain previously provided information.  Note that changes to, or deletion of, your Services account user information does not affect any other information collected by Fishbowl Challenge, which Fishbowl Challenge may retain and continue to use or disclose in accordance with this Policy. 

  3. External Links. This Site may contain links to third-party websites.  If you use these links, you will leave the Site.  We have not reviewed these third-party sites and do not control and are not responsible for any of these sites, their content, or their privacy policy.  Thus, we do not endorse or make any representations about them, or any information, software, or other products or materials found there, or any results that may be obtained from using them.  If you decide to access any of the third-party sites listed on our website, you do so at your own risk.

  4. Security.  We employ physical, technical, and administrative procedures to safeguard the personally identifiable information we collect online. We will maintain reasonable safeguards to protect the security of these servers and your personally identifiable information.  However, no security measures are 100% effective and we cannot ensure or warrant the security of any information you transmit to the Site or to us, and you transmit such information at your own risk. 

  5. Transfer to the U.S. or other Countries.  The information that we collect through or in connection with the Site is transferred to and processed in the United States for the purposes described above.  Fishbowl Challenge also may subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in the United States or countries other than your country of residence.  The data-protection laws in these countries may be different from, and less stringent than, those in your country of residence.  By using the Site or by providing any personal or other information to us, you expressly consent to such transfer and processing.

  6. Children Under 13.  Fishbowl Challenge does not knowingly collect information from children under 13 and the Services are intended for adults over the age of 18 or children over the age of 12 with parental approval. If you are a parent and believe that your child under the age of 13 has used the Services and provided personally identifiable information to us through the Services, please contact us at [info@fishbowlchallenge.com] and we will work to delete that Services account and any such personally identifiable information. 

  7. Changes to this Policy. Fishbowl Challenge may make changes to the Site in the future and as a consequence will need to revise this Policy to reflect those changes.  Fishbowl Challenge will post all such changes on the Site, so you should review this page periodically.  If we make a material change to the Policy, you will be provided with appropriate notice.
